Conveyancing is the legal and administrative process of transferring land or property from one party to another.

What’s included in the conveyancing process?

Whether you are selling or buying, there are many legal and due diligence steps involved in a property transaction to ensure the matter proceeds as seamlessly as possible.

The Process

There are three stages to a conveyancing transaction.

Stage one is the pre-contract stage which is the stage before everything becomes legally binding.

Stage two is the exchange of contracts stage, at which point the transaction becomes legally binding.

Stage three is the completion, which is when the completion of the property sale or purchase takes place.

At the beginning of the transaction when we have been instructed to act for you, we will send you our (rather formal) Client Care Letter setting out the next steps to enable the matter to be progressed.

What’s involved with a sale and purchase?

The work on your matter(s) will consist of the points below. Numbers 1-5 relate solely to a purchase and points 6-9 relate to a sale and or purchase:

  1. Investigating title to the property, raising searches and enquiries
  2. Advising you in respect of your mortgage offer
  3. Preparing a report on title
  4. Calculating stamp duty land tax (SDLT) on the purchase and preparing and submitting to HM Revenue and Customs the appropriate SDLT form
  5. Registering you as the new owner at the Land Registry
  6. Preparing a contract pack and submitting this to the buyer’s solicitors
  7. Dealing with any enquiries raised by the buyer’s solicitors
  8. Negotiating a contract and transfer
  9. Transferring funds electronically

Please note our fees are calculated on the basis that:

  1. The property is held under a single title at the Land Registry with no title defects.
  2. There will only be one contract
  3. The matter will proceed on the basis of an unconditional contract and the property will be bought or sold with vacant possession
  4. Completion takes place on the date agreed in the contract
